TERMS AND CONDITIONS FOR BNF EXPRESS MINI APP USERS

These “Terms and Conditions' are set for User or Customer (“You” “You” “Your” “Yours”) who are going to use BNF Express (''Mini App”) or Merchant ("BNF Express”) in KBZPay App. Those who use BNF Express Mini App shall follow the rules in these Terms and Conditions. By accessing BNF Express App in the KBZPay Blue App and obtaining the BNF Express Mini App Service, it is considered that Users have read, understood and accepted the Terms and Conditions, including the policies and additional Terms and Conditions available Mini App or available by hyperlink. These Terms and Conditions apply to the entire website and all communications, including email or any other type of communication, between you, BNF Express, and Kanbawza Bank (hereinafter referred to as "KBZ"). Terms and Conditions to get BNF Express (Mini App) Service are as follows:

1.1 “Business Day” means a day other than a Saturday, Sunday, public holiday, or bank holiday in Myanmar.

1.2 “CBM” means the Central Bank of Myanmar.

1.3 “KBZ Bank” means Kanbawza Bank Limited and all the branches of KBZ Bank, including any branches that shall be set up by KBZ Bank in the future.

1.4 “KYC” means “Know Your Customers”, requirements for registering issued by the Central Bank of Myanmar and/or other authorities.

1.5 “Mini App” means means the BNF Express (Mini App) owned by the Merchant, a Mini App that can be used in the KBZPay, and KBZPay acts as an agent on behalf of the Merchant to perform the functions of this Mini App and the functions of the App to facilitate Users' orders.

1.6 “Myanmar Kyat” means the official currency of the Republic of the Union of Myanmar.

1.7 “Merchant” means an individual or company that supplies services to the Customer through the BNF Express Mini App.

1.8 “Refund” means any full or part pay that the Customer refuses to honor or demands a refund of because the goods/services purchased from the Merchant were not as they were promised or were defective, deficient, incomplete and/or unsatisfactory for any reason whatsoever or if any Customer order was cancelled by the Customer.

1.9 “Service Fees” means all fees and costs charged for using the Service of Mini App.

1.10 “Services” means products and Services offered by Merchants in Mini App for Users, for which Service fees can be paid through KBZPay.

1.11 “User or Customer” means those who use the Mini App.

1.12 “Vendors” means an individual or company that supplies services to the Customer through the BNF Express Mini App in the KBZPay.{/content} 

{topic}2.OBTAINING AND USING BNF EXPRESS (MINI APP){/topic}

2.1 Users are responsible for ensuring that their own software and hardware are suitable and up-to-date.

2.2 KBZ is not responsible for any services or functions provided by BNF Express, including its performance of failure. If any dispute arising out of User’s canceling or changing process, and the Services received by the Users, the Users can directly contact BNF Express Mini App Call Center mentioned in clause 22, and BNF Express will make a decision on these complaints.

2.3 The User must be at least (18) years of age to use this Mini App. These Terms and Conditions shall apply to the existing laws of the Republic of the Union of Myanmar. Those who wish to use this Service but are under (18) years of age shall agree and accept these Terms and Conditions, and with the approval of parent(s) or legal guardian(s) who are liable for any payment the Users under (18) years of age can obtain this Service. Without the approval of parent(s) or legal guardian(s), the Service User under 18 years of age shall cease using this Service by accessing BNF (Mini App). All use of the Service via the Mini App without the consent of one's parent(s) or legal guardian(s) shall be deemed a breach or non-compliance of these Terms and Conditions.

2.4 The User understands and agrees that Mini App has been introduced to simplify the Service booking process, allowing users to directly search, book, and manage bookings within the Mini App for their preferred Services.

 2.5 KBZ makes no warranty and has no responsibility concerning managing Services reservations available in Mini App, as these are handled solely by the Mini App.

2.6 KBZ shall not make any representations and should not be construed as making any recommendations or suggestions of the level of service quality or rating of BNF Express. KBZ hereby declares denial of any claims, losses or liability with respect to the service quality or status, without limitation to the weakness of service and service interruption of Mini App.

2.7 To be able to use this Service, membership registration shall be made in BNF Express (Mini App) Service. To register as a member, the User needs to provide required information which is updated, correct and complete. To be able to provide Service to the User, to respond to the request of the User, to use in legal affairs, to enforce rules and regulations, to settle any affairs arising out of using the Service, and to send information concerning with the Service, the User shall agree and grant KBZ and Mini App to access User’s information which have been filled when the registration was made to use this Service for maintaining, sharing and disclosing. Registering in Mini App through the mobile phone or email of the User is considered that the User accepts and agrees to send all information on this Service to the mobile phone or email of the User through SMS and SMS link.

2.8 KBZ and BNF Express will ensure the availability of the Mini App and its associated services. However, the User acknowledges that there may be interruptions or delays due to maintenance, updates, or technical issues, and KBZ does not guarantee uninterrupted or error-free services.

2.9 You are prohibited from utilizing Mini App’s Services for unlawful or unauthorized activities and must adhere to all legal regulations while using the Service. All communications, including emails and text messages, exchanged between you and BNF Express Mini App, KBZ may be recorded either to protect the rights, to ensure quality and for legal considerations.

 2.10 According to this Terms and Conditions, User agrees that KBZ has the right to provide personal information and Biometric data, and account data of the User to other parties (outside Service providers or agents), or User’s data mentioned by the User in the Application to use this Service to subsidiaries of KBZ, Branches, financial institutions, Credit Bureau, representatives and legal organizations, and authorizes KBZ to do so.

2.11 These terms and conditions shall be applicable in conjunction with the standard terms and conditions issued for KBZPay.{/content} 

{topic}3.BOOBNF POLICY OF BNF EXPRESS (MINI APP){/topic}

3.1 You can register on Mini App through KBZPay App and o browse, book, and purchase domestic and international airline tickets, bus tickets, domestic and international hotel rooms, travel insurance for outbound trips, online shopping, and delivery-related services partnered with BNF Express, as well as access other services occasionally provided by the Merchant and its Vendors. Prior to booking or reservation Services through Mini App, it is crucial for Customers to thoroughly review and understand these terms and conditions. If there are any queries, Customers should reach out to the BNF Express Call Center as specified in the Clause (22).

3.2 When making a Services booking through BNF Express (Mini App), you will be required to provide required information depending on the Service you wish to purchase, including dates, phone numbers, User details, and contact information. Your reservation is subject to availability at the time of booking before making payment.

3.3 BNF Express and its Vendors shall have the right to reject the Service if there are any discrepancies with information which was provided in booking. Therefore, Customer requires all information to be accurate at the time of booking. In the event of any disputes arising from discrepancies in booking details, the decision of the BNF Express and its Vendors shall be final and binding. 

3.4 KBZ and BNF Express are not responsible for any consequences caused by incorrect information filled/provided by Customer or User booking and making payment through the Mini App User is required to provide accurate and complete information during the reservation process.

3.5 Please note that there will be no refund for advance reservations. The full amount of the stay will be charged at one, based on the information provided by the User at the time of booking and no refund or transfer from changing or cancellation. 

3.6 Customer acknowledges that BNF Express booking or reservation through Mini App mandates full payment.  A successful transaction is necessary to finalize your booking. In the event that payment is successful but a Booking Confirmation for BNF Express booking is not received, or if an error occurs, it becomes your responsibility to reach out to the BNF Express Call Center as specified in the Clause (22). 

3.7 Once the payment is made, the booking is automatically confirmed by BNF Express. If the User leave the current page before making the payment or fail to complete it within the specified time, the User will need to restart the booking process from the initial state.

3.8 You can make booking or reservation according to the Servies and rates listed in the Mini App. However, you understand that your booking or reservation may be canceled at any time for which you have not successfully paid, and that the prices are subject to change. Either from KBZ or BNF Express reserves the right to decline your purchase for any given reason.

3.9 You will only be able to access the Service as stated on the Services you purchased and it is your responsibility to review purchased Services as they cannot be revised in the Mini App. Whether you want to correct a mistake about a Service purchased through the Mini App. time, if you want to change time and Services type, you must contact BNF Express directly as stated in the Clause (22) and you will be subject to the decision of BNF Express and it is not the responsibility of KBZ. For Services purchased from the Mini App on KBZPay, you will only receive a ticket/confirmation delivered electronically, though from KBZ. Once BNF Express or KBZ will never physically issue the physical ticket.  

3.10 Users can view their booking(s) and the details of their successfully purchased services on the "My Booking" page. Customers can access and review the details of their booking confirmation record through the customer’s Mini App reservation history. Customers will be required to show a clear printout of the electronic ticket or by showing the ticket on their Mobile Phone.

3.11 The service level, quality, or rating of the various partner travel services offered within the Mini App are not guaranteed, and any recommendations or clarifications shall not be provided. Therefore, it is hereby declared that the Merchant and KBZ shall not be held liable for any damages or losses arising from the quality or conditions of the existing Vendors (airlines, hotels, and other travel services) listed on the Mini App. Vendors travel services will be automatically categorized and recommended by the system based on predetermined evaluations, such as information, service metrics, and other relevant criteria.  

3.12 Your bookings do not cover any additional fees, expenses, or services not explicitly specified in the description. You are solely responsible for any additional fees, expenses, or services incurred or consumed during your trip/stay.

3.13 Users are required to pay in full for bookings and are only entitled to use the Services in accordance with the dates, times, and details specified in their purchased Service. 

3.14 When purchasing services through the Mini App, users must accurately select options such as itinerary, time, quantity, and citizenship (local or foreigner). If a foreigner incorrectly selects the ticket/service price meant for a local passenger, they must pay the price difference between the local and foreign rate to the merchant.

3.15  The User agrees and understands that any matters arising after reservation from the BNF Express Mini App will pertain solely to the BNF Express and the User shall contact BNF Express directly.

3.16 KBZ act as an intermediary between you and the BNF Express. KBZ is not responsible for any issues that arise directly with BNF Express.{/content} 

{topic}4.SPECIAL REQUESTS{/topic}

4.1 In the event of any special requests (for example: wheelchair assistance for people with disabilities at the hotels, change of name, change of date), the Customers can enter the request at the time of booking at Mini App. The request will be addressed at the Vendor’s and BNF Express’s discretion, based on availability and other factors. User special requests may be subject to additional charges and/or fees by the relevant Vendor based on the discretion and/or policy of the relevant Vendor.

4.2 BNF Express and KBZ are not responsible for the availability and/or fulfillment of User special requests by the Vendor. 

4.3 Merchant and KBZ are not responsible for any violation of these terms and conditions which are agreed on between the relevant Vendor and the User, or which are based on the User’s specific requests, so please read the Vendors’ terms and conditions carefully.

4.4 There are no refunds for services purchased through the BNF Express Mini App under any circumstance. Users must carefully review the respective service details and terms and conditions to check whether services purchased from Vendors are refundable.{/content} 

{topic}5.PRICE AND PROMOTION{/topic}

5.1 BNF Express may offer lower prices and/ or promotions from time to time in Mini App. Please note that these may involve different conditions and requirements which the User need to follow. 

5.2 The User agrees and understands that any matters arising from the promotions will pertain solely to the BNF Express and the User shall contact BNF Express directly as specified in Clause 22 and it shall not be responsible on KBZ. And the User shall comply terms and conditions specified by BNF Express.{/content} 

{topic}6.ADDITIONAL CHARGES{/topic}

6.1 Each price listed in the Mini App is only available with certain conditions and these prices may change depending on the availability of booking, length of booking and/or other factors. Available prices can include additional taxes and other charges, but in certain circumstances it may not include taxes and other service charges. By sending the confirmation email, the User agrees to check the total cost due, as well as other terms, conditions, and details. 

6.2 Users are liable for any additional charges for special request and any damages caused to the room or hotel property during their stay. Charges for damages will be assessed and billed by the hotel in accordance with the privacy policy of the hotel.

6.3 User understands and accepts all the terms and conditions mentioned above and agrees to abide by the terms and conditions set forth by Merchant and the terms and conditions of the Vendors for Users during stay or reservation.{/content} 

{topic}7.TERMINATION, SUSPENSION AND CANCELING OF SERVICE{/topic}

The User can terminate the Service following the rules mentioned in the Service termination clause, if the User has no wish to use BNF Express (Mini App) Service. Without giving prior notice to the User, KBZ or BNF Express (Mini App) may terminate, suspend or cancel the service at any time for any reason. The User agrees and accepts that KBZ and BNF Express (Mini App) shall not be responsible to anyone for such acts. {/content} 

{topic}8.SENDING NOTIFICATION{/topic}

By using the Service provided by BNF Express (Mini App), the User agrees and accepts sending of notifications to BNF Express (Mini App) account of the User and BNF contact through the phone or email address which have been used to open BNF Express (Mini App). Notifications on programs, promotion programs, and surveys collected from the Users will be sent to the Users by BNF Express (Mini App) through a notification in the App or SMS or other means of communication. Moreover, the User accepts sending of information on payment to be made by the User for using service in BNF Express (Mini App); sending agreements, disclosure, and other information. BNF Express (Mini App) has the right to send data, content, text, software, voice mail, photos, designs, videos, messages, and related contents and other content through BNF Express (Mini App) to the User who has bought this Service. The User is the sole responsible person for the data provided when he is registered and any consequences arising out of such data. {/content}

9.1 BNF Express (Mini App) Service is for the User's personal and non-commercial use only. The User shall not record, make screenshots, modify, copy, apply copyright, send to others, resell, forge, produce, distribute, display, present, create, kept in unauthorized devices, or distribute to others through unauthorized means. If found doing so, action will be taken against the offender and the User shall be responsible for the loss of BNF Express (Mini App). The User agrees that in receiving the Service, he will not take the following measures:

9.1.1 using other means which are not of the media arranged by BNF Express (Mini App),

9.1.2 disrupting the service or using other automatic means by using Robot, Spider, Scraper, Script, and Web Crawler. 

9.1.3 concealing the source of receiving the service by forging identifier codes or changing data. 

9.1.4 conducting acts and using software that can harm BNF Express (Mini App) server. 

9.1.5 sending texts, writing emails, or using virus software to disrupt the service.

9.2 The User shall use BNF Express (Mini App) Service in accordance with the Terms and Conditions set by BNF Express (Mini App). The User agrees that he will not use the BNF Express (Mini App) Service by breaching the Terms and Conditions set by BNF Express (Mini App) or exceeding the rules; and without the approval of the concerned official of BNF Express (Mini App), he shall not use the Social Media Pages such as Facebook, Instagram, YouTube and Web Page. 

9.3 As a rule of using this Service, the User assures and guarantees that he will not use this Service with a purpose which is against the law. The User agrees that he will follow the existing law, regulations, by laws and provisions relating to using of Services.{/content}

The User agrees to indemnify, defend, and hold harmless BNF Express or KBZ, its directors, officers, employees, agents, and the third parties from and against any and all claims, demands, actions, suits, liabilities, losses, damages, costs, and expenses (including but not limited to reasonable legal fees and expenses) arising out of or related to any breach of these Terms and Conditions of the Mini App by the User.{/content} 

{topic}11.REPRESENTATION AND WARRANTIES{/topic}

The User acknowledges and agrees that the contents in Mini App is provided “as it is” and “as available”.  Accepting or using any contents, goods or products or services displayed on BNF Express (Mini App) is at the user’s sole risk and discretion. All liabilities for loss and damages of the User or any party relating to using any content on Mini App or services or any website links whether they are stated in the agreement or it is due to ignorance shall be excluded. Although KBZ and BNF Express (Mini App) have exerted reasonable efforts to make sure that services provided can be achieved at all times, KBZ and BNF Express (Mini App) will not guarantee or represent that BNF Express (Mini App) is safe or no technical problems or no interruption or no error or no virus. The User understands and agrees that KBZ and BNF Express (Mini App) will not be responsible for temporary interruption in the platform due to scheduled system maintenance, or the Internet or electronic communication or other forces.{/content} 

{topic}12.INTELLECTUAL PROPERTY RIGHTS{/topic}

KBZ is an owner of all intellectual property rights, whether in contents or wording, pictures, signs, logo, trade service marks, trade name as well as all design works, in all documents, websites of KBZ, and KBZPay Application. BNF Express and its partners and other related businesses are owners of all intellectual property rights, trademarks used in BNF Express Service (including BNF Express Mini App service name and trademarks) whether in contents or wordings, of logo, the name of business, pictures, signs, and trade Service mark. name, logo and Service mark. The User must not exploit the intellectual property right of KBZ or make any advertisement of the BNF Express (Mini App) without receiving prior written consent from KBZ and BNF Express. The User shall not perform or allow any third party to perform any action that might cause damage to the image, trademark, trade name, or other intellectual property right of KBZ and referring to BNF Express (Mini App) Service using such names; references to anything else are not permitted or allow others to do so. {/content}

In any situation, KBZ  including its staff, directors, agents, representatives, and subsidiaries; BNF Express (Mini App) and its partners, members, staff, representatives, and those who have been granted copyright shall not be responsible for the loss of the User and other parties directly or indirectly for breaching of the said Terms and Conditions by the user or due to information received from the service, software, products, and service; lawsuit, litigation, court decision, loss and liabilities according to the agreement or civil case or irrevocable responsibility or cost or damage or claims made against the User. The User understands and agrees that he is the only responsible person to settle such claims.  Regarding the use of BNF Express (Mini App), the remedial action to be taken is to terminate the use of Mini App by the user. Organizations of KBZ, its agents, representatives, and service providers shall not be responsible directly or indirectly or as a consequence for damages and claims for using Mini App by the User. {/content}

The User understands that KBZ and BNF Express (Mini App) shall not be liable for any failure of or delay in the performance of this services for the period that such failure or delay is due to causes beyond its reasonable control, including but not limited to acts of God, war, strikes or labor disputes, embargoes, government orders, fire, flood, torrential rain, storm or other extreme weather conditions, riot, insurrection, civil commotion, sanctions, boycott, failure of electricity, equipment failure, or any other force majeure event. Performance of this service will, to the extent that it is prevented, hindered or delayed by such circumstances, be suspended by KBZ and/or BNF Express (Mini App) until such circumstances cease to exist. KBZ and/or BNF Express (Mini App) will not be liable to the User or any other party or be considered in breach of this terms and conditions for a failure to perform, or delay in performing, any such obligation set out in this terms and conditions while those circumstances continue.{/content}

The above-mentioned Terms and Conditions are legal. As it is deemed that the User understands and agrees to the Terms and Conditions starting from the time of using BNF Express (Mini App), it is the sole responsibility of the User to use this Service without reading the Terms and Conditions.{/content}

The User acknowledges that KBZ and BNF Express (Mini App) reserve the right to amend, modify or substitute any provisions of this Terms and Conditions or, to the Services and/or any charges at any time for any reason at its sole discretion and without any prior notice. The amended Terms and Conditions are in effect as soon as they are posted online. It is considered that with continued use of BNF Express (Mini App) is the user agrees to the amended Terms and Conditions. If the User does not agree with the whole or part of the amended version, the User shall terminate the use of BNF Express (Mini App).{/content}

Each of the provisions of this Terms and Conditions shall be several and distinct from one another. If any of the provisions of these Terms and Conditions becomes invalid, void, illegal or unenforceable in any respect under any law, the validity, legally and enforceability of the remaining provisions shall not in any way be thereby affected or impaired.{/content}

The User shall not assign its rights or obligations under these Terms and Conditions, in whole or in part, nor enter into any subcontract to perform any portion of these Terms and Conditions, without the written consent of KBZ.{/content} 

{topic}19.GOVERNING LAW AND DISPUTE RESOLUTION{/topic}

These Terms and Conditions shall be governed by, and construed in accordance with, the laws of the Republic of the Union of Myanmar and the Courts in Myanmar shall have exclusive jurisdiction to solve any dispute arising from or under these Terms and Conditions.{/content}

Failure or delay on part of either party to enforce any provision(s) of these Terms and Conditions at any point of time shall not be construed to be a waiver by such party of such rights thereafter to enforce each and every provision of these Terms and Conditions.{/content}

This Terms and Conditions is made in both English and Myanmar and both versions shall be equally authentic and effective. In case of any discrepancy between two versions, the Myanmar version shall prevail.{/content}
